These Terms of Service (“Terms”) govern your access to and use of CommentR (the “Service”), provided by Marmostein Group LLP, a limited liability partnership registered under number LL0003346 with its registered office at 5307 Victoria Drive, Unit 1081, Vancouver, British Columbia, Canada (“CommentR,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms.
CommentR is an AI-assisted comment management tool for Facebook Pages, Instagram Business Accounts, and Facebook ad accounts. The Service fetches comments from your connected accounts, generates AI response suggestions using third-party language model providers, and lets Page administrators review, edit, approve, and post replies. Administrators can also like, hide, and delete comments through the dashboard.
You must be at least the age of majority in your jurisdiction and have the legal capacity to enter into a binding agreement. You must also be an administrator of the Facebook Page(s) you connect to CommentR. By connecting your Facebook account, you confirm that you have the authority to manage the Page and its associated Instagram Business Account and ad accounts.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.
You agree to use CommentR in compliance with Meta's Platform Terms, Developer Policies, and Community Standards, and with all applicable laws. You are solely responsible for the content of replies posted through CommentR, including AI-generated responses that you approve. You must not use CommentR to post spam, harassment, hate speech, content that infringes third-party rights, or any content that violates applicable law or Meta's policies.
CommentR uses third-party AI services to generate response suggestions based on comment text. These suggestions are provided as-is and require your review and approval before posting. You are responsible for verifying that AI-generated responses are appropriate, accurate, and compliant with applicable policies before approving them. CommentR does not guarantee the accuracy, appropriateness, or suitability of AI-generated content.
CommentR offers a free trial and paid subscription plans. The features, usage limits, and prices of each plan are described on our pricing page. Paid subscriptions renew automatically at the end of each billing period (monthly or annual) until cancelled. All fees are charged in advance and are exclusive of any taxes that may apply.
You can cancel your subscription at any time from your billing portal. Cancellation takes effect at the end of the current billing period; you will continue to have access to paid features until then.
Refunds. Except where required by applicable consumer law, paid subscription fees are non-refundable. We may, at our discretion, issue partial or full refunds in cases of billing error or service unavailability.
EU consumers: if you reside in the European Union, you may have a 14-day right of withdrawal under Directive 2011/83/EU on consumer rights when you purchase a digital service. To exercise this right, contact [email protected] within 14 days of your subscription start. Note that, where you expressly consent to immediate provision of the digital service and acknowledge that you lose the right of withdrawal once performance begins, this right may no longer apply.
We offer a time-limited free trial with capped usage. The trial does not require a payment method. At the end of the trial, you must subscribe to a paid plan to continue using the Service. Trial usage limits are described in-app and may be adjusted by us from time to time.
CommentR, including its software, design, branding, and documentation, is owned by Marmostein Group LLP and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for your internal business purposes during the term of your subscription.
You retain ownership of the content you submit to or generate through the Service, including comments, replies, and brand voice training data. You grant us a limited licence to process this content solely to provide the Service to you.
Your use of CommentR is subject to our Privacy Policy. We rely on a number of sub-processors to deliver the Service; see our Sub-processors page for the current list. You can revoke access to your Meta data at any time via your Facebook Business Integrations settings.
CommentR is provided on an “as-is” and “as-available” basis. We do not guarantee uninterrupted or error-free service. The Service depends on third-party APIs (including Meta, OpenAI, and Anthropic) that may experience downtime or change without notice. We may modify, suspend, or discontinue features of the Service at any time. We will give reasonable notice of material changes that adversely affect paying customers.
To the maximum extent permitted by applicable law, CommentR disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, CommentR shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to damages from posted replies, loss of data, loss of profits, or interruption of service. Our total aggregate liability arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred Canadian dollars (CAD 100), whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including consumer rights and liability for fraud or gross negligence.
You agree to indemnify and hold harmless Marmostein Group LLP and its partners, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service in violation of these Terms or applicable law, (b) the content of replies you post through the Service, and (c) your violation of any third-party right, including any Meta platform policy.
You may stop using CommentR at any time by cancelling your subscription, deleting your account in-app (Settings → Account → Delete Account), or removing CommentR from your Facebook Business Integrations settings. We may suspend or terminate your access to the Service if you violate these Terms, if required by Meta's policies or applicable law, or if your account remains inactive for an extended period. Upon termination, we will delete your data in accordance with our Privacy Policy, except where retention is required by law.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The courts of British Columbia, Canada shall have exclusive jurisdiction over any dispute arising from or related to these Terms or the Service, subject to any non-waivable consumer protection rights available under the law of your country of residence.
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top and, where reasonable, notify you through the Service or by email. Your continued use of CommentR after the effective date of a change constitutes acceptance of the updated Terms.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and CommentR regarding the Service. If any provision is held to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
